Terms and Conditions

This is a contract between you (hereinafter “Client”) and Mini, Mouse Counselors, Mouse Counselors, Counselors Travel, or an independent agent of either entity (hereinafter “Travel Agent”). By using our services, you are signifying your agreement with the following terms and conditions, on behalf of yourself and all members of your traveling party.

Scope

Mini Mouse Counselors recognizes the faith and trust you put in us to plan your travel. We will do our utmost to create and deliver the perfect trip for you. Our aim is to provide you with outstanding personalized service. We will book your dining and recreation reservations for you, based upon current availability, when the applicable booking window opens. Please note our Mini Mouse Counselors cannot control or guarantee availability of reservations for dining options, recreation activities, or Lightning Lanes. We will respond to your messages promptly and will keep you informed as your itinerary evolves. If at any time you have questions or concerns we ask that you let us know immediately so we can address them.

Only the goods and services specifically stated to be included in the offering, package or itinerary are included in the prices quoted by Travel Agent or Supplier and/or paid by Client. Transportation to a destination or property, shore excursions, tours, side trips, lodging, food and beverage, or other goods and services not specifically stated to be included will be the responsibility of the Client.

Travel Documentation

Client assumes full responsibility for checking, verifying and obtaining all necessary travel documentation for entry into the destinations in your itinerary, including, but not limited to passports, visas, inoculation certificates or other entry requirements. Travel documentation requirements are subject to change and changes or updates may not be reflected in this paragraph. It us up to the Client to check and comply with current requirements. Please consult www.travel.state.gov for more information and to verify that each traveler in your party has the necessary documentation. Please check any documentation sent to you by Travel Agent for accuracy, verifying name, date, and travel arrangement if applicable. The first, middle and last name, date of birth and gender of each passenger provided to the Travel Agent for booking purposes must be exactly as it appears on the traveler’s identification that will be used while traveling – no exceptions.

For international travel, passports must be valid for at least six (6) months after your scheduled return. Some countries require that your passport have two (2) to four (4) blank visa/stamp pages. When traveling domestically or internationally, it is recommended that each traveler carry at least two (2) forms of acceptable identification.

Payments, Cancellations and Changes to Bookings

Client Responsibility and Payment Authorization

The client is fully responsible for all charges, fees, duties, taxes, and assessments related to travel bookings made through the Travel Agent. By submitting credit card information, you authorize the Travel Agent to use your payment method to purchase travel products from our Suppliers on your behalf.

Role of the Travel Agent

The Travel Agent acts solely as a booking agent and is not the source or supplier of the travel services requested. Our Suppliers include cruise lines, hotels, airlines, ground transportation, tour operators, and other service providers (collectively referred to as “Suppliers”). Each Supplier operates independently and is not under the control of the Travel Agent. Suppliers have their own terms and conditions, including cancellation policies, change fees, and penalties. By using our services, you consent to these terms, even if you do not receive prior notice of them.

If you wish to change any confirmed arrangements prior to departure or during your trip, we will make every effort to assist you. However, certain bookings may not be changeable, and you will be responsible for any increased costs and Supplier change fees. All change requests must be submitted in writing via electronic mail.

Liability Disclaimer

The Travel Agent does not guarantee the financial stability of Suppliers and is not liable for their acts or omissions, including failures to provide goods or services or adhere to schedules and pricing. Any recourse for such issues must be directed to the defaulting Supplier, not the Travel Agent. The Travel Agent is also not responsible for cancellations or refunds from Suppliers that cease operations, whether temporarily or permanently.

Payment Methods and Disputes

We strongly recommend using a credit card for payments to enable you to exercise rights under the Fair Credit Billing Act if services are not delivered as purchased. Except in cases of fraud, you agree not to dispute charges with your bank or credit card company to avoid violating any terms or conditions of the Travel Agent or its Suppliers, including cancellations or itinerary changes due to circumstances beyond our control. If you initiate a chargeback or reverse a previously authorized payment, the Travel Agent reserves the right to recover any costs, fees, or expenses incurred as a result, including attorney fees.

Pricing

Price quotes are applicable to the date and time at which they are provided. Rates are always subject to change and are not guaranteed until booked.

Quotes in foreign currency are subject to fluctuations depending on exchange rates and international credit card issuer fees. Travel Agent is not responsible for any price increases due to fuel surcharges, government-imposed taxes and/or fees, or supplier-imposed increases during travel.

Travel arrangements involving airline and cruise components are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. Client hereby consents to such price increases and authorizes Client’s credit or debit card to be charged. In the event of any pricing error or omission,

Travel Agent reserves the right to adjust such pricing or make any other corrections in advance of Client travel dates.

Check-Ins and Departures

It is Client’s responsibility to reconfirm all domestic and international flight details and recommended check-in times prior to departure. Checking in later than these recommended times may result in denied boarding. Recommended check-in times are subject to change without notification. It is the Traveler’s responsibility to check airport conditions or rules that might require earlier arrival times. This information can be found when entering your confirmation number on the airline’s website. Travel Agent does not assume any responsibility for any flight or schedule changes. Please note that certain countries impose departure taxes that require payment in cash.                                                 

Travel Protection/Insurance

For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance.

Travel Agent is not qualified or authorized to answer questions about benefits, coverage, exclusions, or conditions of any protection plans offered or purchased, nor to evaluate the adequacy of the existing coverage. No representation or description of the insurance made by Travel Agent constitutes a binding assurance or promise regarding any insurance policy offered or purchased. For questions or more information on any plans offered or purchased, please call the number included on the travel protection quote or plan provided by Travel Agent.

Unless noted, travel insurance is not included in the cost of your itinerary. Information for travel insurance will be sent to you within a reasonable time frame based on trip and components.

Travel Safety and Immunizations

Client assumes full responsibility for checking all conditions regarding health, safety, security, political stability, strikes and labor or civil unrest at any and all destinations in Client’s itinerary. Travel Agent has no special knowledge regarding unsafe conditions, strikes, health hazards, weather hazards, or climate extremes at locations to which Client may travel. For information concerning possible dangers at any destination, Travel Agent recommends Client contact the Travel Warnings Section of the U.S. State Department at (202) 647-5225 or www.travel.state.gov.

Client assumes full responsibility to ensure that all travelers have the proper vaccinations for any international destinations in the itinerary prior to traveling. Please see your health provider or a medical professional for advice regarding the necessary or recommended vaccinations and documentations thereof. Travel Agent may provide recommendations regarding potentially necessary vaccinations, but in so doing does not assume any responsibility or liability for any vaccinations or failure to receive vaccinations required for travel. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to or living in a foreign country. STEP allows you to provide information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended. International Entry and Exit Requirements

Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If any member of the Client’s travel party has a current or prior criminal offense, Client should contact that country directly for entry and exit requirements. You can visit the US State Department Website for further information about these requirements. See, https://travel.state.gov/content/travel.html. We do not inquire about an individual’s criminal record in the interest of respecting our Clients’ privacy. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record or with judgements for unpaid child support should review current entry requirements. Waiver of Liability

Travel Agent shall not be liable for any accident, injury, property damage, refund, delay, inconvenience or personal loss to Client or to those traveling with Client in connection with any travel services we have booked, including, but not limited to: acts of God, weather conditions, natural disasters, acts of government or other authorities, wars, civil disturbances, riots, strikes, epidemics or pandemics, acts of terrorism, breakdown in equipment, theft, delay, fuel increases, or cancellation or changes in itineraries or schedules. Travel Agent shall not be liable for any loss which may be caused by (1) any defaults, wrongful or negligent acts or omissions of any Supplier; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under the control of Travel Agent; and (4) any Supplier price drop after Client’s travel arrangements have been confirmed, paid in full, or ticketed.

Client hereby releases Travel Agent from all claims arising out of any provision covered in this agreement. Client agrees that the courts in Plymouth County, Massachusetts will be the exclusive jurisdiction for all claims brought by Client or Travel Agent, and by entering into this Agreement Client hereby submits to the personal jurisdiction of those courts.
